DPS Criminal History Records Request

New Fee Schedule

Effective January 2010

The New Mexico Department of Public Safety operates and maintains the State’s AFIS (Automated Fingerprint Identification System). NMAFIS is a complex, technology driven system that encompasses over one hundred pieces of hardware, including live scans stationed at detention centers around New Mexico, card scans distributed throughout New Mexico at various governmental agencies, and servers residing at the DPS complex. The system operates on very complex, proprietary software platform that makes “biometrics” possible. The maintenance of the hardware and software has been part of DPS’s business model and business cost since implementing the new AFIS system in 2007.

Maintenance of the system into the future is a core concern for all involved. Since maintenance costs have not been approved as a general fund line item in fiscal years 2010 and 2011, DPS was left with limited options to cover this ever increasing cost. The only logical choice, and most efficient by far, was to increase the fees charged to the end user community. Realizing up front the current and projected economic conditions, the overall increase in fees are nominal to the typical applicant, who usually bear the cost of processing a background. The average applicant will see an increased cost of $3.75 to $5.00.
Effective January 1, 2010, the New Mexico Department of Public Safety will be implementing the following fee schedule:

Additionally, if you require notary services on site at the Santa Fe DPS facility, a $5.00 fee will be charged.

The New Mexico State Central Repository for Criminal History maintains arrest record information on persons arrested in New Mexico for felony, misdemeanor (offenses punishable by six months or more imprisonment) and DWI offenses.

This information is based on fingerprint cards taken at the time of arrest, which serve as the source document for criminal history and are submitted to this State Repository by the arresting agency. The completeness and accuracy of this information is dependent on the contributing agencies.

Pursuant to 29-10-6(A) of the New Mexico Arrest Record Information Act, an individual may inspect, in person, through his counsel, or through his authorized agent, arrest record information concerning him/her.

To obtain arrest record information, a Department of Public Safety (DPS) Authorization for Release of Information form (click here for Spanish Version) must be completely filled out (legibly) and submitted to this agency for processing. The form must be notarized and the fee is $12.00 per record check, which should be a money order or cashiers check made payable to the Department of Public Safety. The DPS must receive the authorization form with the "original" signature. With the required release and proper payment, all adult arrest records are released.

If a "Police Certificate of Good Standing" is needed (usually for immigration purposes), the cost of the certification with the background check is $27.00.

The turn around time is seven to 15 working days from the date of receipt (depending on the current volumes and workload) and should only be requested by mail. Attached is the required release form, which may be duplicated.
