Excess DoD Personal Property Resources for Law Enforcement Agencies

Providing excess DoD Personal property for over 10 years to eligible state and federal agencies.

What is the 1033 Program?

Under Section 1033 of the National Defense Authorization Act for fiscal year 96 and 97, the Secretary of Defense is authorized to transfer to federal and state agencies, personal property that is excess to the needs of the Department of Defense and that the Secretary determines is suitable to be used by such agencies in the execution of law enforcement activities to include counter-drug and counter-terrorism missions. The 1033 program was formerly known as the 1208 program.

How does my organization acquire property?

Law enforcement agencies (LEA) must request to their state coordinators enrollment into the 1033 program. Once the state coordinator approves the request, the request is forwarded to the Law Enforcement Support Office (LESO).

The LEA must appoint officials to screen for property for their agency. Screening can take place either by visiting the local Defense Reutilization and Marketing Office or electronically. Once the property is identified, DRMS Form 103 is completed and submitted to your state coordinator. The state coordinator will approve or disapprove this request.

If approved it will be sent to LESO where final approval on the property to be transferred will be made.

Law enforcement agencies that receive property must cover all transportation costs incurred. Property received by LEAs is in "as is", "where is" condition.

Who can participate in the 1033 Program?

Federal and state law enforcement agencies in all 50 states and the US territories of American Somoa, Guam, Puerto Rico and the US Virgin Islands whose primary function is the enforcement of applicable federal, state and local laws and whose compensated law enforcement officers have the powers of arrest and apprehension.
